## PREAMBLE

These Terms of Service (hereinafter "Terms" or "ToS") define the terms and conditions of use of the Peekigo mobile application (hereinafter "the Application" or "Peekigo"), as well as the rights and obligations of the parties.

The Application is published by:

## ARTICLE 1 - DEFINITIONS

In these Terms, the following terms shall have the meanings set out below:

- **Application**: refers to the Peekigo mobile application, available on iOS (App Store) and Android (Google Play Store) platforms.

- **User**: refers to any natural person using the Application, whether registered or not.

- **Account**: refers to the User's personal space created upon registration on the Application.

- **Content**: refers to all information, texts, images, sounds, videos, and other elements made available through the Application.

- **Services**: refers to all functionalities offered by the Application, including guided tour routes, information about artworks and museums, and any other functionality accessible through the Application.

- **Publisher**: refers to the company PEEKIGO that publishes and operates the Peekigo Application.

## ARTICLE 2 - PURPOSE

These Terms define the conditions under which:

- The Publisher makes the Peekigo Application available to Users;
- Users access the Services offered by the Application;
- The respective rights and obligations of the parties are established.

The Peekigo Application is a mobile solution enabling Users to benefit from an enhanced visiting experience in partner museums and cultural venues, through personalized audio, text, and visual content.

## ARTICLE 3 - ACCEPTANCE OF TERMS

Access to and use of the Application are subject to acceptance of and compliance with these Terms.

By downloading, installing, or using the Application, the User acknowledges having read these Terms and accepts them without reservation.

The Publisher reserves the right to modify these Terms at any time. Modifications take effect upon their publication in the Application. The User is invited to regularly consult the Terms. Continued use of the Application after modification of the Terms constitutes acceptance of the new conditions.

## ARTICLE 4 - ACCESS TO THE APPLICATION

### 4.1 Access Conditions

The Application is accessible to any User with internet access and a compatible mobile device (smartphone or tablet).

Browsing the catalog (museums, cultural venues, and experiences) may be available without purchase, but using experiences is a paid service.

The User bears sole responsibility for the costs of equipment necessary to use the Application as well as telecommunications costs (internet connection, mobile plan, etc.).

### 4.2 Technical Compatibility

The Application is compatible with iOS and Android versions supported at the time of installation through official app stores.

The Publisher does not guarantee the operation of the Application on earlier versions or modified devices (jailbreak, root, etc.).

### 4.3 Availability

The Publisher endeavors to ensure the availability of the Application 24 hours a day, 7 days a week, without obligation of result.

Access to the Application may be interrupted for maintenance, updates, or in case of force majeure. The Publisher shall not be held liable for any damages resulting from such interruptions.

## ARTICLE 5 - REGISTRATION AND USER ACCOUNT

### 5.1 Account Creation

The use of certain features of the Application may require the creation of a User Account.

To create an Account, the User must:
- Be at least 16 years old (or have authorization from a legal guardian);
- Provide accurate, complete, and up-to-date information;
- Accept these Terms and the Privacy Policy.

### 5.2 Login Credentials

The User is solely responsible for the confidentiality of their login credentials (email address and password).

Any use of the Application made from the User's Account is presumed to have been made by them.

In case of loss, theft, or unauthorized use of their credentials, the User must immediately inform the Publisher at: contact@peekigo.com

### 5.3 Account Deletion

The User may request the deletion of their Account at any time by sending a request to contact@peekigo.com or through the Application settings.

The Publisher reserves the right to suspend or delete any Account in case of violation of these Terms, without notice or compensation.

## ARTICLE 6 - DESCRIPTION OF SERVICES

### 6.1 Catalog Access

The Application allows Users to browse available museums, cultural venues, and experiences.

### 6.2 Paid Services

Using experiences in the Application is a paid service.

Commercial options currently include:
- pay-per-experience purchases;
- snap-based bundles (for example, 50 snaps or 100 snaps).

Applicable prices, quantities, usage rules, and payment terms are those displayed in the Application at checkout.

### 6.3 Payment and Billing Terms

Payments made through the Application are processed through a secure payment provider (including Stripe).

The applicable price is the one displayed in the Application at checkout validation. Unless otherwise stated, prices are shown inclusive of applicable taxes.

The charge is made when the transaction is confirmed.

Peekigo does not store Users' full card numbers.

Receipts and transaction records are issued by the relevant payment providers or app stores, depending on the payment method used.

### 6.4 Snap Usage Rules

When an experience or action consumes snaps, the required number of snaps is displayed in the Application before confirmation.

The available snap balance can be viewed in the Application.

Unused snaps do not constitute electronic money and are not cash-redeemable.

### 6.5 Cancellation, Refunds, and Right of Withdrawal

Unless otherwise required by mandatory law, purchases of digital content/services that are performed immediately are non-refundable.

In the event of a technical failure attributable to the Publisher or an erroneous charge, the User may contact support at contact@peekigo.com so an appropriate adjustment can be reviewed (reactivation, re-credit, or refund, as applicable).

Rules regarding the right of withdrawal are specified in the Appendix to these Terms.

### 6.6 Service Delivery

The digital service is delivered immediately after payment confirmation (activation of associated usage rights for the experience or credited snaps).

### 6.7 Museum Partnerships

Peekigo works in partnership with museums and cultural institutions. The content offered is developed in collaboration with these partners or based on reliable documentary sources.

## ARTICLE 7 - USER OBLIGATIONS

### 7.1 Compliant Use

The User agrees to use the Application in accordance with these Terms, applicable laws and regulations, and good morals.

### 7.2 Prohibited Conduct

The User is prohibited from:

- Using the Application for illegal or unauthorized purposes;
- Attempting unauthorized access to the Publisher's computer systems;
- Reproducing, copying, modifying, distributing, or using the Application's Content without prior authorization;
- Using automated devices (robots, scrapers, etc.) to collect data from the Application;
- Disrupting the operation of the Application or associated servers;
- Impersonating a third party or providing false information;
- Publishing or transmitting any illegal, defamatory, offensive content, or content infringing third-party rights.

### 7.3 Respect for Cultural Venues

When using the Application in a museum or cultural venue, the User agrees to:
- Respect the internal rules of the visited venue;
- Not disturb other visitors;
- Use headphones for audio content;
- Respect areas where phone use is prohibited.

### 7.4 Prohibition of Scraping, Data Mining, and AI Training

The User shall not conduct, facilitate, authorize, or permit any text mining, data mining, or web scraping activities in relation to the Application, including but not limited to:

- Using any robot, bot, spider, scraper, or other automated device, program, tool, algorithm, code, process, or methodology to access, obtain, copy, monitor, or republish any portion of the Application, its Content, or its Services;
- Any automated analytical technique aimed at analyzing text and data in digital form to generate information, including but not limited to patterns, trends, and correlations;
- Collecting, copying, or extracting data, content, or information for the purpose of training, developing, or improving artificial intelligence models, machine learning systems, or algorithmic systems.

These provisions constitute an **express reservation of our rights** within the meaning of Article 4(3) of the EU Directive 2019/790 on copyright in the Digital Single Market.

This prohibition applies to the fullest extent permitted by applicable law.

### 7.5 User Generated Content (if applicable)

If the Application allows Users to publish content (reviews, comments, photos, lists):

**License Granted**: By publishing content on the Application, the User grants the Publisher a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, translate, publish, distribute, and display such content on all media and by all means, for any purpose related to the operation and promotion of the Application.

**User Warranties**: The User warrants that they are the author or hold all necessary rights to the content they publish, that such content does not infringe any third-party rights (including copyright, image rights, privacy), and that they have obtained the consent of any identifiable persons appearing in their photos or videos.

**Moderation**: The Publisher reserves the right, without obligation, to moderate, refuse, modify, or remove any content published by a User, at any time and without notice or justification, particularly in case of non-compliance with these Terms.

### 7.6 Indemnification

The User agrees to indemnify, defend, and hold harmless the Publisher, its officers, employees, partners, and subcontractors from and against any claim, complaint, lawsuit, action, demand, or damage (including reasonable attorney's fees) brought by third parties arising from:
- The User's violation of these Terms;
- Infringement of third-party rights by content published by the User;
- The User's use of the Application in violation of applicable laws and regulations.

## ARTICLE 8 - INTELLECTUAL PROPERTY

### 8.1 Publisher's Rights

The Application, its structure, design, and content (texts, images, sounds, videos, databases, software, etc.) are protected by intellectual property law.

The Publisher owns or holds licenses to all intellectual property rights relating to the Application and its content.

### 8.2 License of Use

The Publisher grants the User a personal, non-exclusive, non-transferable, non-assignable, and revocable license to use the Application in accordance with these Terms.

This license does not confer any ownership rights to the Application or its content.

### 8.3 Restrictions

Any reproduction, representation, modification, publication, transmission, alteration, in whole or in part, of the Application or its content, by any means whatsoever, without the prior written authorization of the Publisher, is prohibited and constitutes infringement punishable under intellectual property laws.

### 8.4 Trademarks

Peekigo and the Peekigo logo are trademarks [registered / pending registration] by the Publisher.

Any unauthorized use of these trademarks is prohibited.

## ARTICLE 9 - PERSONAL DATA

Personal data collected by the Publisher in connection with the use of the Application is processed in accordance with the Privacy Policy, accessible in the Application and on the Publisher's website.

The User is invited to consult this Privacy Policy to learn about the conditions for collecting, processing, and protecting their personal data, as well as their rights in this regard.

## ARTICLE 10 - LIABILITY

### 10.1 Nature of the Service

The Peekigo Application is a **cultural mediation tool** that allows Users to scan artworks to obtain related information and content.

**The Application does not provide** practical information about museums (opening hours, prices, access conditions, exhibition availability, etc.). Users are invited to contact the relevant cultural establishments directly for such information.

### 10.2 Content Generated by Artificial Intelligence

The User acknowledges and accepts that all or part of the cultural content provided by the Application (artwork descriptions, historical information, artistic commentary, etc.) is **generated or enhanced by artificial intelligence technologies**.

This content is provided **for informational and educational purposes only**. The Publisher:
- Does not guarantee the accuracy, completeness, timeliness, or relevance of this content;
- Disclaims all liability for any error, omission, or inaccuracy in AI-generated content;
- Recommends that Users verify information from official sources for any use other than personal and recreational.

### 10.3 Content Provided by Partner Museums

Some content may be provided directly by partner museums and cultural institutions. The Publisher:
- Acts solely as a technical intermediary for the distribution of such content;
- Does not control and does not guarantee the accuracy of content provided by partners;
- Disclaims all liability for content from third parties.

For any complaint regarding content provided by a partner museum, Users are invited to contact the relevant establishment directly.

### 10.4 Exclusions of Liability

To the fullest extent permitted by applicable law, the Publisher **expressly excludes all liability** for:

**a) Cultural Information and Content**
- Any error, inaccuracy, or omission in content (whether AI-generated, provided by partners, or from any other source);
- Any contested or contestable artistic, historical, or cultural interpretation;
- Any content that has become obsolete or inappropriate.

**b) Application Operation**
- Temporary interruptions for maintenance, updates, or improvements;
- Malfunctions, bugs, or technical errors;
- Inability to access the Application for reasons beyond the Publisher's control (network issues, hardware incompatibility, etc.);
- The quality of artwork recognition during scanning (which may vary depending on lighting conditions, camera quality, etc.).

**c) Museum Practical Information**
- Opening hours, prices, access conditions, or exhibition availability of museums (information that the Application does not provide);
- Any inconvenience related to visiting a museum (unexpected closure, missing artwork, etc.).

**d) User Conduct**
- The use that the User makes of the content provided by the Application;
- Decisions made by the User based on information from the Application;
- The behavior of Users or any third party.

### 10.5 Excluded Damages

Under no circumstances shall the Publisher be held liable for the following damages, even if informed of their possibility:

- Loss of profit, revenue, savings, or turnover;
- Loss of chance or opportunity (including missing an exhibition, a visit, etc.);
- Loss or corruption of data;
- Loss of reputation or customers;
- Moral or emotional harm;
- Any indirect, incidental, special, or consequential damages;
- Any harm resulting from force majeure.

### 10.6 Limitation of Warranty

The Application and its content are provided **"as is"** and **"as available"**, without warranty of any kind, express or implied, to the fullest extent permitted by law.

The Publisher does not warrant that the Application will meet the User's specific expectations or that it will operate uninterrupted or error-free.

### 10.7 Preserved Liability

Notwithstanding the above exclusions, nothing in these Terms shall limit or exclude the Publisher's liability:
- For death or personal injury resulting from its negligence;
- For fraud, willful misconduct, or intentional fault;
- For any liability that cannot be limited or excluded under applicable law.

### 10.8 Force Majeure

The Publisher shall not be held liable for failure to perform its obligations resulting from force majeure, as defined by applicable law.

## ARTICLE 11 - HYPERLINKS

The Application may contain hyperlinks to third-party websites or applications.

The Publisher exercises no control over these third-party sites and applications and disclaims any responsibility for their content, practices, or damages that may result from their use.

Access to these sites and applications is at the User's sole responsibility.

## ARTICLE 12 - DURATION AND TERMINATION

### 12.1 Duration

These Terms are concluded for an indefinite period, from the User's acceptance.

### 12.2 Termination by the User

The User may terminate their use of the Application at any time by uninstalling it from their device and, if applicable, requesting the deletion of their Account.

### 12.3 Termination by the Publisher

The Publisher reserves the right to suspend or terminate any User's access to the Application, without notice or compensation, in case of:
- Violation of these Terms;
- Conduct prejudicial to the interests of the Publisher or third parties;
- Fraudulent or abusive use of the Application.

## ARTICLE 13 - MODIFICATION OF TERMS

The Publisher reserves the right to modify these Terms at any time.

Modifications will be brought to the attention of Users by any appropriate means (notification in the Application, email, etc.).

Continued use of the Application after modification of the Terms constitutes acceptance of the new conditions. In case of disagreement, the User must stop using the Application.

## ARTICLE 14 - APPLICABLE LAW AND JURISDICTION

### 14.1 Applicable Law

These Terms are governed by French law.

### 14.2 Dispute Resolution

In case of dispute relating to the interpretation or performance of these Terms, the parties agree to seek an amicable solution before any legal action.

Before any legal action, the User is invited to submit their claim to Peekigo support at contact@peekigo.com in order to seek an amicable resolution.

The claim must describe the facts and, where possible, include useful transaction references (date, amount, payment identifier, account email).

Peekigo acknowledges receipt within a reasonable timeframe and endeavors to provide a response within fifteen (15) business days.

### 14.3 Evidentiary Value

Computer records, technical logs, and transaction traces kept by Peekigo or its payment providers constitute admissible evidence between the parties, except in case of manifest error.

### 14.4 Competent Jurisdiction

Failing amicable resolution, any dispute shall be submitted to the competent courts of Versailles, subject to mandatory consumer protection provisions.

## ARTICLE 15 - SEVERABILITY

If one or more provisions of these Terms are held invalid or declared as such under any law, regulation, or final decision of a competent court, the other provisions shall remain in full force and effect.

## ARTICLE 16 - NON-WAIVER

The Publisher's failure to enforce any breach by the User of any of the obligations set forth in these Terms shall not be construed as a waiver of the obligation in question.

## APPENDIX - INFORMATION ON THE RIGHT OF WITHDRAWAL

### For digital content and service purchases:

In accordance with applicable consumer protection laws, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium whose performance has begun with the consumer's prior express consent and acknowledgment of loss of the right of withdrawal.

When purchasing digital content in the Application, the User will be asked to confirm their agreement for performance to begin immediately and their waiver of the right of withdrawal.
